JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-02-2018 Heard learned counsel for the petitioners and State. The petitioners apprehend their arrest in connection with Srinagar P.S. case no. 27 of 2014 for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 325, 380, 448, 427, 504 and 506 of the Indian Penal Code.
Mr. Shailendra Kumar Singh, learned counsel appearing on behalf of the petitioners, submits that in the present case the police after investigation submitted final form. He also placed reliance on the order dated 05.01.2026 passed by a
Patna High Court Cr.Misc. No.7490 of 2018 (2) dt.17-02-2018 2/2 Coordinate Bench of this Court in Cr. Misc. No.125 of 2016 whereby Gauri Shankar Chaudhary and two others were granted anticipatory bail, order dated 11.08.2016 passed in Cr. Misc. No.31586 of 2016 whereby Girbal Ghaurhdary @ Girbal Kumar Chaudhary has also been granted anticipatory bail and order dated 15.10.2015 passed in Cr. Misc. No. 47366 of 2015 whereby ten persons were granted anticipatory bail.
In view of the above, the petitioners, named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Madhepura in connection with Srinagar P.S. case no. 27 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
