JUSTICE RAKESH KUMAR ORAL ORDER 04-10-2016 Heard Sri Pramod Kumar Singh, learned counsel for the petitioner and Sri Chaubey Jawahar, learned Additional Public Prosecutor.
The petitioner, who is husband of the deceased, has prayed for grant of bail in Halsi P.S. Case No. 16 of 2016 registered for the offence under Section 304(B) / 34 of the Indian Penal Code.
By way of referring to the post -mortem examination repot of the deceased, it was strenuously argued by learned counsel for the petitioner that it was not a case of homicide but it was a case of suicide. He tried to persuade the court that injuries found on the neck of the deceased categorically indicates that it was a case of suicide. On aforesaid grounds a prayer has been made for grant of bail.
Patna High Court Cr.Misc. No.40635 of 2016 (2) dt.04-10-2016 2/2 Learned Additional Public Prosecutor opposing the prayer submits that sister of the informant was married with the petitioner only two years back and there is allegation of demand of dowry and torture.
Keeping in view the nature of accusation as well as the fact that petitioner is husband of the deceased, there is no reason to extend the privilege of bail.
The petition stands dismissed.
