In this application for anticipatory bail the petitioner apprehends his arrest in connection with Danapur P.S. Case No. 477 of 2016 for the offences punishable under section 306 of the I.P.C and section 67 of the Information & Technology Act. Allegedly, the daughter of the informant committed suicide due to mental torture given to her by the petitioner as the petitioner has sent wrong photo of daughter of the informant on the whatsapp of Sheo Bacchan Singh with whom marriage was settled.
Submission is of false implication and that the deceased has not written any suicidal note, there is no legal and
Patna High Court Cr.Misc. No.44016 of 2017 (2) dt.21-09-2017 2/2 tangible material against the petitioner, only one piece of paper was seized upon which name of the petitioner was written, the petitioner has got no criminal antecedent and he has been implicated due to ulterior motive and as such he deserves sympathetic consideration.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.
In the facts and circumstances stated above, considering the allegation attributed against the petitioner, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of A.C.J.M. Danapur (Patna).
