JUSTICE SATYAVRAT VERMA ORAL ORDER 11-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Town P.S. Case No. 45 of 2021 instituted for the offences under Sections 115, 120B (i) and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 17.01.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that informant in the F.I.R. alleges that he received a message from STF that an under trial prisoner in Begusarai is planning to commit a serious crime, planning was to kill a clerk of Teghra Block for Rs. 2 lakhs to Rs. 2.5 lakhs but assailant was
Patna High Court CR. MISC. No.37356 of 2021(2) dt.11-01-2022 2/3 demanding Rs. 4 lakhs. On inquiry, it revealed that mobile was of one Sonu Kumar who disclosed that mobile was being used by his brother Deepak Kumar and when Deepak was apprehended, he disclosed that call was made to Raja Sahani in Begusarai Jail and also disclosed that petitioner had requested help by disclosing that his friend Lalan Kuer had dispute with his agnate Rakesh Kumar and for his murder, Lalan Kuer is willing to part with money but Raja Sahani was demanding Rs. 4 lakhs and thus Deepak was arrested who testified about the land dispute between Lalan Kuer and Rakesh Kuer. Further, Lalan Kuer was arrested who disclosed that he wanted Rakesh Kuer to be killed.
Learned counsel for the petitioner submits that allegation against this petitioner is that he had contacted Deepak informing him that there was a land dispute between Lalan Kuer and Rakesh Kuer based on which Deepak had talked to one criminal in Begusarai Jail for killing of Rakesh Kuer. Learned counsel further submits that allegation is of abetment but no one was killed in the occurrence.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody

No.37356 of 2021(2) dt.11-01-2022 3/3 since 17.01.2021, charge-sheet has been submitted in the case, petitioner is a person with clean antecedent and his name transpired in the confessional statement of co-accused Deepak Kumar, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Town P.S.
