2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 61(2), 318(4), 338, 336(3) and 340(2) of the B.N.S..
3. As per prosecution case, informant alleged that the land appertaining to Khata No. 85, Khesra No. 455, Area 13 Katha 3 Dhur was registered in the name of his ancestors. Informant is great grand-son of Dulam Ahir and Jamabandi of the aforesaid plot is running in the name grand-father of informant, namely Dahari Ahit and till the year 2023-24, informant has paid rent of the said land and later on, he came to

No.27357 of 2025(2) dt.07-05-2025 2/3 now that the said plot was sold by co-accused Musmat Sukhani Devi to her daughter-in-law i.e. Petitioner No. 1 on the basis of forged and fabricated documents and thus, all the accused persons named in the F.I.R., including these petitioners, cheated the informant.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioner No. 1 is bona fide purchaser and Petitioner No. 2 is identifier of the sale deed. As a matter of fact, the land in question was in peaceful possession of co-accused Most. Sukhani Devi and Petitioner No. 1 since long ago and Petitioner No. 1 is residing on the same land and has built her residential house over the same. The land in question was sold by great grandfather of informant, namely Late Bhardul Ahir to husband of co-accused Most. Sukhani Devi, namely late Sheonanadan Yadav in the year 1938 itself and since then, the family of Petitioner No. 1 resides over the land. It is further submitted that from bare perusal of the F.I.R. it is apparent that the dispute is with regard to sale and purchase of land which is purely civil in nature. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently
Patna High Court CR. MISC. No.27357 of 2025(2) dt.07-05-2025 3/3 opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Yogapatti P.S. Case No. 249 of 2024, subject to condition as laid down under Section 482(2) of the B.N.S.S..
