The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 111.75 litres of liquor was recovered from a hut belonging to the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the case. He is in custody since 25.3.2021.

It is submitted that the petitioner has antecedent under the Bihar Prohibition and Excise Act, 2016. Pursuant to the order of this Court a sum of Rs. 10,000/- has been deposited

A supplementary affidavit filed on behalf of the petitioner not being on record, the filing of the original affidavit is accepted and taken on record. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for more than 1 year, the petitioner is directed to be enlarged on bail in connection with Excise Case no. 304 of 2020 (arising out of P.R. no. 2 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
