This application for grant of anticipatory bail arises out of Siwan Mufassil P.S. Case No. 155 of 2016, disclosing offences under Sections 147, 148, 149, 323, 324, 307, 337, 379, 353, 332, 333,427,504,506 of the Indian Penal Code and Sections 3⁄4 of the Damage to Property Act as well as Section 61 of the Bihar Excise Act (Amendment), 2016.

There are 60 persons named and 250 to 300 not named in the First Information Report, who are said to have committed the offence. Allegedly, the accused persons caused obstruction in due discharge of official duties by the police personnel. They damaged police vehicle and hurled stones on the police party

causing injuries.

Learned counsel for the petitioners has submitted that those who were apprehended have been granted regular bail by this Court and that there is no specific allegation against these petitioners.

Considering the above, this application is allowed. Let the petitioners above named in the event of their arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Siwan Mufassil P. S. Case No. 155 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
