2. The accused/petitioner seeks bail in connection with Tikapatti P.S. Case No. 40 of 2023 registered for the offences under Sections 420, 406, 467, 468, 471 and 34 of the Indian Penal Code.
3. The accused/petitioner is named in the First Information Report and is in custody since 20.11.2024.
4. As per FIR, Rs. 76 Lakhs was given to the petitioner by the informant to invest the same in Kishan Vikas Patra, where Rs. 20.5 Lakhs only was returned to the informant.
5. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.29215 of 2025(6) dt.02-12-2025 2/3 behalf of the petitioner that the dispute is related with financial transaction where allegation against this petitioner is only to persuade the informant to invest money for higher return in Kishan Vikas Patra. It is submitted that there is no allegation that amount as given to the petitioner on pretext of depositing the same with Kishan Vikas Patra was not invested. It is pointed out that after maturity Rs. 21.33 Lakhs was returned to the account of informant, Rs. 10.30 Lakhs was returned to the account of one Nilam Devi, who is sister of the informant, Rs. 8.69 Lakhs was returned to Kailash Rajak, who is the brother-in-law of informant and Rs. 3.30 Lakhs was returned to the Shankar Suman, who is the full-brother of the informant; total of Rs. 44.12 Lakhs on his instruction only. It is submitted that now the petitioner is under the liability of Rs. 2.23 Lakhs only.
6. Learned A.P.P. for the State duly assisted by learned counsel for the informant, while opposing the prayer of bail of the petitioner, submitted that informant received only Rs. 20.50 Lakhs in terms of F.I.R.
7. In view of aforesaid factual submission and by

No.29215 of 2025(6) dt.02-12-2025 3/3 taking note of the fact as primarily the allegation of cheating raised against petitioner out of monetary transaction and admitted position of investment through petitioner, coupled with the fact that investigation of this case is already completed, where petitioner remains in custody since 20.11.2024, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea/concerned court, in connection with Tikapatti P.S. Case No. 40 of 2023, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
