====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-06-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Section 304(B) of the Indian Penal Code.

The present bail application has been filed in terms of the liberty granted to the petitioner by order dated 02.02.2022 in Cr. Misc. No. 49482 of 2021 whereby the petitioner was granted liberty to renew his prayer for bail in the event if the trial is not concluded within a period of three months from the date of order i.e. 02.02.2022.

Learned counsel for the petitioner submits that till date the trial has not concluded and the next date fixed is 30.06.2022.

Since the trial has not concluded as directed by order dated 02.02.2022 in Cr. Misc. No. 49482 of 2021, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Session Trial No. 197 of 2019 arising out of Alamganj P.S. Case No. 387 of 2018, subject to the condition that if the learned court below comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner then in that event the learned court below shall forthwith cancel the bail bond of the petitioner by recording reasons.
