Patna High Court CWJC No.18293 of 2014 dt.27-07-2023 2/3 following relief:- "1. That this application is being filed for a direction to the respondent authorities to grant Assured Career Progression to the petitioner from the due date in view of the fact that several juniors to the petitioner have been granted the aforesaid pay scales. Further to direct them to grant consequential monetary benefits along with statutory and penal interest."

At the outset, the learned counsel for the Respondents has submitted, by referring to paragraph no. 8 of the counter affidavit, filed in the present case that the petitioner has already been granted the benefits of ACP scheme, vide order dated 9.3.2016.

In view of the aforesaid, the learned counsel for the petitioner submits that nothing survives for consideration in the present writ petition, however, the Respondents be directed to pay the actual monetary benefits arising out of grant of benefits of the ACP scheme to the petitioner, in case the same has not already been paid.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the Respondents to make payment of the
