====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 09.03.2020 in connection with Industrial Area Hajipur P.S. Case No. 28 of 2020 registered for the offences punishable under Sections 25(1-b)a/26/35 of the Arms Act and Section 20/21/22/23/24 of the Narcotic Drugs and Psychotropic Substance Act. As per the prosecution case, 5 Kg. Ganja has been recovered from the possession of the petitioner. It is further submitted that mandatory provisions with regard to search and seizure has not been complied with and the petitioner has been falsely implicated in this case by the police and he is in custody since 09.03.2020.

It is submitted that the amount of recovery is below

Patna High Court CR. MISC. No.27638 of 2020(3) dt.07-12-2020 2/2 commercial quantity and petitioner is in custody since 09.03.2020. It is further submitted that chargesheet has already been submitted in this case and petitioner has got no criminal antecedent as stated in paragraph No. 3 of the petition. Considering the aforementioned facts and circumstances the bail application of this petitioner is allowed. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Cum Special Judge (NDPS Act), Vaishali at Hajipur in connection with Industrial Area Hajipur P.S. Case No. 28 of 2020.
