====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 08-12-2021 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Pasraha P. S. Case No.105 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 03.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 422.910 litres of foreign liquor from a thatched house near the premises of the petitioner. The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.37694 of 2021(2) dt.08-12-2021 2/2 neither the place of occurrence nor the alleged recovery belongs to the petitioner. Petitioner has no concern with the said liquor. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 03.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Khagaria in connection with Pasraha P. S. Case No.105 of 2020.

The application stands allowed.
