2. This is the 2nd attempt of the petitioner seeking bail in connection with N.D.P.S. Case No. 61 of 2024 arising out of Katihar Town (Sahayak) P.S. Case No. 659 of 2024 registered for the offence under Sections 21(c), 22(c) and 25 of the N.D.P.S. Act.
3. Earlier the bail application of the petitioner was rejected on 16.09.2025 in Cr. Misc. No. 35185 of 2025 which reads as follows:- Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with N.D.P.S. Case No. 61 of 2024 arising out of Katihar Town (Sahayak) P.S. Case No. 659 of 2024 registered for the offence under Sections 21(c), 22(c) and 25 of the N.D.P.S. Act.

3. 300 bottles of Codeine Cough Syrup has been recovered from the petitioner, who is in jail since 02.01.2025.
4. Considering the huge recovery and the criminal antecedents of the petitioner, this application for regular bail stands rejected.
4. In the trial, out of nine witnesses, four witnesses have been examined.
5. Considering the huge recovery of more than commercial quantity and fact that the trial is progressing, I am not inclined to grant regular bail to the petitioner. Accordingly, this application for regular bail stands rejected. (Sandeep Kumar, J) Shishir/- U T
