JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-11-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 385, 504, 506 of the Indian Penal Code.

The prosecution case in brief is that on 08.03.2019 at about 5.00 pm unknown criminals from Mobile No. 8541964526 demanded Rs. 5,00,000/- (five lacs) as ransom telling the name of father of the informant. He also threatened to shot fire. Informant informed about this occurrence to this family members. Later on, it came in the knowledge of informant that from the same Number at about 5.15 pm, two lacs rupees ransom was demanded and criminal was threatened to shot fire.

Patna High Court CR. MISC. No.24517 of 2020(3) dt.02-11-2020 2/2 Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Chargesheet has been submitted u/s 387 of the I.P.C is not made out against the petitioner. The petitioner is in jail custody since 12.07.2019.

Learned APP for the State opposes the prayer for bail petition and submits that the petitioner is accused in another 05 cases.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Dhamdaha P.S. Case No. 63 of 2019 from the Court of learned C.J.M., Purnea. Accordingly, this application is dismissed.

However, the petitioner is at liberty to renew his prayer for bail after framing of charge (Anjani Kumar Sharan, J) amitkumar/- U T
