Petitioner seeks bail in connection Khajauli P.S. Case no. 242 of 2020 registered for the offence punishable under sections 414, 272, 273 of the Indian Penal Code read with section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 16.04.2021 and is person with clean antecedent and charge sheet has been submitted. Allegation is of recovery of 510 liter Nepali liquor from a Scarpio. Learned counsel further submits that two persons were apprehended from the vehicle who disclosed that vehicle belonged to the petitioner. Learned counsel next submits that petitioner was not aware what driver was carrying in the vehicle

Patna High Court CR. MISC. No.37109 of 2021(2) dt.07-12-2021 2/2 and he is merely owner of the vehicle.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody since 16.04.2021 and is person with clean antecedent and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge, Excise Act, Madhubani in Khajauli P.S. Case no. 242 of 2020.
