The petitioners apprehend their arrest in connection with Madhuban P.S. Case No. 195 of 2016 registered under Sections 363, 365 and 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that petitioners have no criminal antecedent This is a case of love affairs between petitioner no.3 and victim. Further submission is that on perusal of the statement of the
Patna High Court Cr.Misc. No.39656 of 2017 (2) dt.30-08-2017 2/2 victim, recorded under section 164 Cr. P.C., it appears that the victim married with petitioner no.3 according to her sweet will and was living in her Sasural where she was arrested by the Police. She wants to live with her husband in her matrimonial house. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV, Motihari, East Champaran in connection with Madhuban P.S. Case No. 195 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
