JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 This is an application for grant of anticipatory bail in connection with Dulhin Bazar P.S. Case No. 300 of 2017, disclosing offences under Sections 302/34 of the Indian Penal Code.
Prosecution case is that petitioner and other accused persons surrounded the husband of the informant and abused and assaulted by lathi and rod, causing injury, who has taken to Hightech Hospital, where he died.
Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and the police after investigation has not found the case true against him, however, cognizance has been taken. Further submission is that other co-accused have already been granted privilege of anticipatory bail by Co-ordinate Benches of this Court, which will appear from the impugned order itself.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of leaned A.C.J.M.-III, Danapur, District Patna, in connection with Dulhin Bazar P.S.
