The petitioner is apprehending arrest in a case registered for the offences punishable under sections 272,273 and 420 of the Indian Penal Code and section 47(a) of the Excise Act. The prosecution case is that one gas cylinder of 5 liter and 200 liters of raw spirit were recovered from the hutment of the petitioner. Other co accused persons were arrested who suggested that the petitioner escaped from the scene. It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the alleged hutment belongs to the petitioner. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Barauli P.S. Case No. 180 of 2015 pending in the court of learned JM Ist Class, Gopalganj. This application is disposed of with the aforesaid observation/direction.
