JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467,468,471,420 and 409/34 of the Indian Penal Code.

The prosecution case is that the Branch Manager of Uttar Bihar Gramin Bank, Puraini Bazar, Maduepura in league with Rajeev Ranjan Yadav, Buchan Ram and Ranjeet Ram withdrew the amount under the KCC and GCC schemes in the name of the informant and others. The petitioner is not named in the FIR. He was also in league with the accused persons in the whole conspiracy.

It is submitted by the learned counsel for the petitioner that considering the fact that the loanees when failed to repay the

Patna High Court Cr.Misc. No.1516 of 2016 (2) dt.12-01-2016 2/2 loan amount, used to make frivolous cases lodged. The Branch Manager of Uttar Bihar Gramin Bank has been granted anticipatory bail vide Cr. Misc. No. 17262 of 2015, whereas the persons whose names subsequently sprang up during investigation namely Santosh yadav alias Santosh Kumar Yadav has been granted anticipatory bail vide Cr. Misc. No. 48841 of 2015 and Manish Devi has been granted anticipatory bail vide Cr. Misc. No. 48791 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Udakishunganj, Madhepura in connection with Puraini P.S. Case No.104 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
