JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-09-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the state.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Kharagpur P.S. Case No. 231 of 2017 for the offences punishable under sections 381, 409 and 420 of the I.P.C.
Allegedly, the petitioner being Chairman of PACS did not deposit 253.63 quintals of CMR to the State Food Corporation and misappropriated the amount of Rs. 5,62,146=75 paisa. Submission is of false implication and that the millers have not given rice in time resulting some rice was not handed over, but now the petitioner is ready to deposit Rs 5,62,146=75 paise within reasonable time and as such the petitioner deserves

The learned A.P.P. submits that one month time should be given to the petitioner to deposit the said amount. In the facts and circumstances stated above, the petitioner is directed to deposit Rs. 5,62,146=75 paisa before the concerned authority within two months and then the petitioner after showing receipt of the deposit, shall be enlarged on bail by the learned court below itself on execution of bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each and in the meantime, the petitioner is granted provisional bail for two months in connection with the aforementioned case pending in the court of C.J.M. Munger.
Accordingly, this Criminal Miscellaneous is hereby disposed of.
