2. The petitioner seeks bail in connection with Brahmpur P.S. Case No. 588 of 2023 instituted for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 324 of the Indian Penal Code.
3. The allegation against the petitioner along with others is of brutally assaulting the informant by means of pistol butt, due to which he sustained injury. It is further alleged that the accused persons snatched the cash of Rs. 11,000/- from the informant.
4. Learned counsel for the petitioners submitted that the petitioner has falsely been implicated in the present case.
Patna High Court CR. MISC. No.31595 of 2024(2) dt.25-04-2024 2/2 Charge-sheet has been submitted in this case. He submitted that as per Injury report dated 25.09.2023 the injuries are found in simple in nature, but as per the injury report dated 22.01.2024, the injury is found to be grievous, but on the other hand Sharda Hospital and Trauma Centre Clinically examined the case on 26.09.2023 but the doctors found injury in simple in nature. This creates doubt on the case of the prosecution. The petitioner is in custody since 30.12.2023 and has no criminal antecedent.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Brahmpur P.S. Case No. 588 of 2023.
