Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 302, 201/34 of the Indian Penal Code. Allegation is that the informant's daughter was married with the petitioner and after marriage the accused persons subjected her to mental and physical cruelty for demand of dowry. The informant further alleged that the accused persons killed her by strangulation.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.9.2018. Charge sheet has

Patna High Court CR. MISC. No.27104 of 2019(2) dt.26-04-2019 2/2 been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. There is no eye witness to the occurrence. The petitioner has falsely been implicated in the present case. The deceased is said to have died due to illness. There is no substantive evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Anju Singh, learned A.C.J.M., Sasaram, District Rohtas in connection with Chenari P.S. case No.170 of 2015.
