JUSTICE PARTHA SARTHY ORAL ORDER 21-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The instant application for regular bail has been filed by the petitioner in connection with Kasim Bazar P.S. Case No. 232 of 2019 registered under section 394 of the Indian Penal Code to which sections 395, 397 and 412 of the Indian Penal Code was added subsequently.

As per allegation in the FIR, on the informant entering his house it transpired that a robbery had occurred in the house and his brother and brother's wife had sustained injuries on their head. They were taken for treatment. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The petitioner's name transpired in the confessional statement of Chotu Singh@

Patna High Court CR. MISC. No.27688 of 2020(3) dt.21-12-2020 2/2 Gaurav made before the police. No incriminating article has been recovered from the petitioner's possession who is in custody since 17.10.2019. It is submitted that a number of coaccused including those whose order has been brought on record as Annexure-3 series, have been enlarged on bail. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner, the period in custody and grant of bail to the coaccused, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Sessions Trial No.93 of 2020 (arising out Kasim Bazar P.S. Case No. 232 of 2019) on his furnishing bail bond of Rs. 10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Munger.

It is directed that the petitioner shall remain present in the learned trial Court on each date of the trial. (Partha Sarthy, J) Bibhash/- U T
