====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kuchaikot P.S. Case No.222 of 2018 registered under Sections 341, 323, 331, 332, 384, 353, 420, 504 and 506/34 of the Indian Penal Code.

The accusation is that the informant, who was deputed as Magistrate at Balthari Check Post, in the evening of 20.07.2018, was present there. At that time, this petitioner and one Ranjeet Shahi alias Tarki Shahi came there and introduced themselves to be the reporters of Fast News and asked to release their vehicle without issuing Challan, then the informant replied that without issuance of Challan, the vehicle would not be released. Thereafter, they became annoyed and asked that they would implicate him by preparing fake

After that, they called 3-4 persons on phone and gave threatening that they would create trouble in his service and made hindrance in performing his official duty and took away their vehicle. Learned counsel appearing on behalf of the petitioner submits that, in fact, due to misunderstanding, the informant has lodged the present case. Later on, the informant filed a compromise petition on 28.11.2018 in the court of the Sessions Judge, Gopalganj, at the time of hearing of the Anticipatory Bail Application No.2027 of 2018 filed on behalf of the petitioner to compromise the case. Further submission is that the petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Gopalganj, in connection with Kuchaikot P.S. Case No.222 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
