The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act.

Total 123 liters 840 ml. of illicit foreign liquor has been recovered from a car, which was possessed by this petitioner and he is alleged to have fled away after seeing the police.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case on account of Panchayat Election. Nothing has been recovered from the possession of this petitioner and has got no concern either with the seized liquor or car.

No.29024 of 2022(2) dt.12-08-2022 2/2 However, learned A.P.P. for the State vehemently opposed the prayer for bail and submitted that petitioner cannot escape from his liability, since huge quantity of illicit foreign liquor has been recovered from a car, which was parked in front of house of petitioner, and was possessed by this petitioner. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
