The petitioners apprehend their arrest in connection with Rafiganj P.S. Case No. 164/15 registered for offences punishable under Sections 341, 323, 307, 379/34 of the Indian Penal Code.

It is contended on behalf of the petitioners that there is allegation upon the petitioner no. 1 Sanjay Singh of firing from gun and Awajeet Kumar of assaulting by 'Khanti' causing injury upon the informant on the order given by petitioner no. 3 Baidnath Singh but there is only one lacerated wound on the head of the informant which is simple in nature. It is stated that this

Patna High Court Cr.Misc. No.58338 of 2015 (2) dt.25-01-2016 2/2 case is counter blast of Rafiganj P.S. Case No. 163/2015 which was lodged by the petitioners' side.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Sanjay Singh, Awajeet Kumar and Baidnath Singh @ Baijnath Singh be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Rafiganj P.S. Case No. 164/2015, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
