JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341/323/324/307/34 of the Indian Penal Code.

Allegation in the F.I.R. is that petitioner Ashok Mandal caught the informant and petitioner Rajendra Mandal assaulted with Dabia causing injury on the face of the informant. The impugned order reveals that simple injury was found on the person of the informant. The impugned order further reveals that the Court-below had directed the learned Magistrate to consider the prayer for regular bail without being prejudiced by the impugned order.

No.49695 of 2016 (2) dt.19-12-2016 2/2 Considering the aforesaid fact, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Saharsa/Successor Court in connection with Basnahi Police Station Case No.45 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
