JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 This application, for grant of anticipatory bail, arises out of Amarpur P.S. Case No. 664/18, disclosing offences under Sections 447, 147, 148, 149, 341, 323, 379, 385, 354(B), 504 and 506 of the Indian Penal Code.

Allegation against the petitioners is of entering inside the house of informant and assaulting him and also taking away Rs. 50,000/- and when the granddaughter of the informant came coaccused Sonu Poddar tried to outrage her modesty and co-accused Ritesh Kumar and Ranjit Poddar misbehaved with the daughter of

Submission of learned counsel for the petitioners is that there is enmity between the parties from before and out of the said enmity, this false case has been lodged and so far criminal antecedent of petitioner no. 1 and 2 are concerned, those case has also been lodged by the informant side. Further submission is that a case has also been lodged by the petitioner no. 2 against the informant and he has also received injuries.

Heard learned A.P.P. also.

Having heard both sides, in view of above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case No. 664/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
