2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126(2), 115(2), 109, 352, 351(2), 351(3) and 3(5) of the Bharatiya Nyaya Sanhita . 3 . It is alleged that all the F.I.R., named accused persons including this petitioner assaulted husband, mother-in -law and father-in -law of informant on account of which they sustained injury .
4. It is submitted on behalf of the petitioners that from bare perusal of F.I.R., it is manifest that no specific allegation of assault is alleged against this petitioner. Case and couunter case . Patna High Court CR. MISC. No.27815 of 2025(2) dt.07-05-2025 2/2 granted bail by Co-ordinate Bench this Court vide order dated 05.05.2025 in Cr. Misc. No. 25068 of 2025 .
5 . Learned counsel for the State opposed the bail petition .
6 Considering the fact that similarly situated coaccused persons have already granted bail, allegation of assault is general and omnibus against this petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class Gaya in connection with Neemchak Bathani P.S. Case No. 230 of 2024 subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
