ANJANA MISHRA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners apprehended their arrest in connection with Muffasil P.S. Case No. 189/2008 registered for the offences punishable under Sections 448, 341, 323, 504, 379, 384 and 34 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel for the petitioners submits that earlier these petitioners had surrendered in the Court below and taken regular bail but subsequently on submission of charge sheet, section 307 of the Indian Penal Code was also added and they are

Patna High Court Cr.Misc. No.3205 of 2016 (4) dt.12-04-2016 now apprehending their arrest once again. It is submitted that the petitioners were earlier granted bail and have not misused the privilege of bail and therefore in view of the changed circumstances, they may be extended the privilege of anticipatory bail.

In the facts and circumstances of the case and also that these petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Begusarai in connection with Muffasil P.S. Case No. 189/2008 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) Amit/- U T
