Petitioner seeks bail in a case registered for the offence punishable under Sections 498A, 304 B and 34 of the Indian Penal Code.

Informant has alleged that petitioner (husband) assaulted and ousted her from her matrimonial house due to non-fulfillment of demand of dowry. It has been further alleged that petitioner on 25.05.2018 set her ablaze and thereafter took her in hospital and fled away along with his family members. Her statement was recorded by executive magistrate and thereafter she died.

Earlier also, petitioner had moved this Court for grant of regular bail which was rejected vide Annexue 1.

Patna High Court CR. MISC. No.27641 of 2020(5) dt.22-03-2021 2/2 Vide order dated 21.10.2020, case diary along with report was called for from the court concerned as with regard to the stage of trial.

Report of the trial court has been received, which is kept at Flag B, in which, it has been stated that out of 11 witnesses, 5 witnesses have been examined and 24.02.2021 has been fixed for examination of remaining prosecution witnesses. In view of the above, considering the aforesaid facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the trial court is directed to expedite the trial of the petitioner and conclude the same within a period of one year from the date of receipt/production of a copy of this order. S. Kumar, J) Sanjay/- U T
