The petitioner apprehends his arrest in Chanpatia P.S. case No. 258 of 2016 for the offences punishable under Section 395 of the Indian Penal Code.

The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner figured in the case in the confessional statement of co-accused Anwar Alam and the petitioner has got no criminal antecedent but it appears that Anwar Alam confessed his guilt and in pursuance thereof the looted tractor and the goods were recovered. Be that as it may, considering the fact that it is a case of dacoity in which the I.O. may require custodial interrogation of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.
