Petitioner, in the present case, is seeking quashing of Memo No. 1514 dated 28.06.2003 as contained in Annexure '6' issued by Civil Surgeon-Cum-Chief Medical Officer, Aurangabad.

Learned counsel for the petitioner as well as learned counsel for the State do not dispute that the subject matter of the present case is squarely covered by the judgment of the Hon'ble Supreme Court in the case of State of Bihar and Others vs. Devendra Sharma reported in (2020) 15 SCC 466 and by following the said judgment, this Court has disposed of a

Patna High Court CWJC No.22148 of 2011(3) dt.20-02-2023 2/2 number of writ applications some of them are CWJC No. 15887 of 2010 and CWJC No. 18030 of 2010.

In the aforesaid view of the matter, this Court finds no merit in this writ application.

It is dismissed accordingly.
