Petitioner apprehends his arrest in connection with Dinara P.S. Case No.56 of 2016 for the offences registered under section 379 and other minor sections of the Indian Penal Code. Petitioner and other F.I.R. named accused are said to have assaulted the informant by means of sharp cutting weapons as well as fists and slaps when the informant demanded cost of wine. The informant also claims that petitioner and his associates took away Rs.25,000/- cash from his shop.

Learned counsel for the petitioner submits that no specific overt act has been attributed against the petitioner and moreover, the informant has sustained simple injury though five in number

Patna High Court Cr.Misc. No.40267 of 2016 (2) dt.21-11-2016 2/2 but the aforesaid injuries are not dangerous to the life of the informant. It is further pointed out that petitioner does not have any criminal antecedent and no purpose would be served, if he is sent behind the bar.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Rajiv Kumar, Bikramganj (Rohtas) in Dinara P.S. Case no. 56 of 2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
