Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioner apprehends his arrest in connection with Mansi P. S. Case No. 34 of 2021 registered for the offences punishable under Sections 406, 409, 420, 504, 506, 509 and 34 of the of the Indian Penal Code.
The allegation against the petitioner is of defalcating of Rs. 246157/-.
The electricity company had directed the petitioner to deposit the amount vide Annexure No. 2 and the same has been deposited by the petitioner vide Annexure no. 4. Considering the aforesaid fact, the present
Patna High Court CR. MISC. No.37135 of 2021(2) dt.25-03-2022 2/2 anticipatory bail application is allowed.
Accordingly, let the petitioner, above named, be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/ (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P. S. Case No. 34 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
While accepting the bail bond of the petitioner, the Court below shall verify the factum of deposit from the Advocate for the Electricity Company and then accept the bail bond of the petitioner. If the deposit is disputed by the electricity company, the petitioner shall be taken into custody. (Sandeep Kumar, J) shakir/- U T
