The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 354B/34 of the Indian Penal Code. It is alleged that the accused persons entered into the house of the informant on 23.8.2015 at 9.30 P.M. and started abusing and molesting the informant when the mother of the informant came to rescue, she was assaulted. It is further alleged that co accused Mantu Singh tore the salwar of the informant whereas co accused Santosh assaulted the informant with iron rod on her head.

No.456 of 2016 (2) dt.08-01-2016 2/3 It is submitted by the learned counsel for the petitioner that specific accusation of assault is only against co accused Mantu and Santosh. It is further submitted that co accused Mantu gave twenty five thousand rupees to the father of the informant for execution of a sale deed but he neither executed the sale deed nor returned the money, hence Title Suit No. 208 of 2015 was filed whereas co accused Mantu Singh also filed Complaint Case No. 2211 of 2015 against the informant side. Both are still pending. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the fact that title suit as well as criminal case were filed by the accused side at earlier point of time and statement in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with
