In this case, the petitioners are apprehending their arrest in connection with Maharajganj P.S. Case No. 257 of 2018 registered for offences under sections 304(B), 201, 34 of the Indian Penal Code.

An allegation has been made that the daughter of the Informant has been killed by the family members of her-in-laws. Learned counsel for the petitioners submits the petitioner no.1 Sangita Devi is the married woman and she lives with her husband at Kolkata and she was also under treatment at ESIS Hospital. The petitioner no.2 Ajay Prasad is also living in West Bengal for his livelihood and his Adhar Card, Pan Card, Driving Licence are issued from the West Bengal.

The corroborative material in the shape of different identity cards itself reflects that they stay in the West Bengal not in the State of Bihar.

Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, V, Siwan in connection with Maharajganj P.S. Case No. 257 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
