Since the physical court proceeding is non-functional, due to present pandemic COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of physical court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Sections 406, 409, 467, 468, 420, 120B and 34 of the Indian Penal Code.

Patna High Court CR. MISC. No.27844 of 2020(2) dt.05-11-2020 2/2 Counsel for the petitioner submits that he has been implicated on the basis of statement of co-accused Amit Pandey. He draws attention of the court towards order dated 26.08.2019 passed in Cr. Misc. No. 51828 of 2019 whereby said Amit Pandey has been allowed bail. He submits another similarly situated co-accused has been granted bail by coordinate Bench of this court in Cr. Misc. No. 78645 of 2019 on 03.12.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur in connection with University Police Station Case No. 44 of 2018.
