JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 323, 380 and 427 of the Indian Penal Code read with Section 3(i)(x) of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that the accused persons including the petitioners came in the house of the informant assaulted her and abused her by naming her caste and taken away

It is submitted by the learned counsel for the petitioners that for the occurrence of 03.04.2010, the complaint was filed on 16.04.2010 wherein the cognizance was taken on 15.05.2010. None has received any injury. Statement has been made to this effect in paragraph 9 of the petitioner. The petitioners have got no criminal antecedent. Moreover, the place of occurrence is the house of the informant.

Considering the delay in lodging the case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge, Nawada in connection with Complaint Case No. 402 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
