JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 393, 504, 364 of the Indian Penal Code. Though the F.I.R does not suggest that Section 302 I.P.C is added but it is submitted by learned counsel for the informant that Section 302 I.P.C has been added.

The prosecution case is that the informant was sleeping with his brother on the roof of the house when eight persons including the petitioner came and abducted the brother of the informant. Subsequently the dead body of the brother of the informant was recovered.

It is submitted by learned counsel for the petitioner that thrust of accusation is against Nunu Sah who confessed the guilt and petitioner has only been roped in the

Patna High Court Cr.Misc. No.2790 of 2016 (2) dt.22-01-2016 2/2 case since he is brother of Nunu Sah.

Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner. Accordingly the application stands dismissed in connection with Madhwapur P.S. Case No. 28 of 2015, pending in the Court of learned Chief Judicial Magistrate, Madhubani.
