JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and State. The petitioner apprehends his arrest in connection with Chandan P.S. case no. 36 of 2017 for the offence under Sections 341, 323, 504, 506, 467, 468, 471, 406, 420, 409 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that the instant case is a pressure tactics adopted by the complainant on account of Jamabandi created in connection with certain land of Mauza Baghmari, Circle Chandan, District Banka. Learned counsel for the petitioner submits that in the totality of the facts situation one can understand the reason behind filing the present case. The dispute is essentially a civil dispute, for which the complainant has filed the present complaint case.

No.14466 of 2018 (2) dt.06-04-2018 2/2 Considering the fact that the petitioner has no criminal antecedent and the origin of this case is essentially a dispute, which is of civil nature, the petitioner, named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Chandan P.S. case no. 36 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
