JUSTICE RAVI RANJAN ORAL ORDER 27-01-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363, 363 (A), 364 and 34 of the Indian Penal Code.

It is contended that the petitioner is not named in the First Information Report and he was not apprehended from the spot, however, he has been made accused on the basis of confessional statement of the co-accused, namely, Dhananjay Rai. It is further contended that the petitioner is co-villager and neighbour of the informant, as such, the victim boy could have easily named him in his statement but he has not taken his name.

Having regard to the facts and circumstances of the

No.58340 of 2015 (2) dt.27-01-2016 2/2 case, let the petitioner, namely, Mangal Sahani @ Raj Mangal Sahani be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Madhuban P.S. Case No.04/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Rajeev KumarIV, Judicial Magistrate-1st Class, East Champaran, Motihari subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
