It is submitted by the learned counsel for the petitioners that petitioner nos. 5 and 6, namely, Nand Kishore Yadav and Dayaram Mehta have already been arrested and, thus, this application has become infructuous as against them. It is dismissed as such as against them.
Rest of the petitioners apprehend arrest in a case registered for the offences punishable under sections 420 and 467 of the Indian Penal Code.
In view of the fact that the complaint case was
Patna High Court Cr.Misc. No.41770 of 2016 (2) dt.23-09-2016 2/2 filed in the year 1997 and after almost 19 years, this anticipatory bail application has been filed, I am not inclined to grant privilege of anticipatory bail to the petitioners in connection with Complaint Case No. 414-C of 1997 pending in the court of the learned Chief Judicial Magistrate, Supaul.
However, the petitioners may surrender and pray for regular bail which will be considered on its own merit in accordance with law without being prejudiced by this order. (Navaniti Prasad Singh, J) Amin/- U
