The petitioner seeks pre-arrest bail in connection with Sikty P.S. Case No. 78 of 2015 registered under Section 302 read with 34 of the Indian Penal Code.

It is contended that there is no allegation in the first information report that the petitioner ever subjected the daughter of the informant to cruelty in any manner. On the contrary, the informant has stated in the FIR that the petitioner and his family members took their best efforts to save the life of the daughter of the informant when she had started vomiting incessantly. Learned counsel for the State has submitted that though the doctor did not find any ante mortem injury on the body of the

Be that as it may, regard being had to the nature of allegation in the FIR, in the event of arrest or surrender in the court below within four weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Sikty P.S.Case No. 78 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
