The petitioner apprehends his arrest in Govindpur P.S. Case No. 70/2016, registered for the offences punishable under Section 47(A) of the Excise Act.
The S.H.O. of Govindpur searched a bus and found in the dickey of the bus different brands of Whisky and 100 pouches of country made liquor each containing 200ml were recovered. The driver and the conductor were enquired. The conductor disclosed that the petitioner is the owner of the wine. Learned counsel for the petitioner submits that the petitioner has no manner of concern with the wine. The conductor and the driver of the bus were carrying the wine and they in order to get rid of the police implicated the petitioner.

No.43335 of 2016 (3) dt.19-11-2016 2/2 Considering the facts aforesaid and the fact that nothing has been recovered from the possession of the petitioner and the petitioner is not even passenger of the bus, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Govindpur P.S. Case No. 70/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
