The petitioner apprehends his arrest in Baheri P.S. Case No.226/2017 registered under Sections 307 and other minor sections of the Indian Penal Code.
The informant alleged that the petitioner asked her not to worship in the temple and for that some altercation took place. Co-accused Mritunjay Sao and others came and began to abuse her. Bajrangi Sao is alleged to have assaulted the informant Janki Devi with rod on her head, causing bleeding injury on her head. Learned counsel for the petitioner submits that of course the petitioner is named in the F.I.R. but no specific allegation of assault is made against the petitioner. Bajrangi Sao is
Patna High Court Cr.Misc. No.17677 of 2018 (3) dt.09-04-2018 2/2 alleged to have assaulted with iron rod on her head. Janki Devi got two lacerated wound. One on frontal head and another on right lower arms. Both the injuries are opined to be simple in nature. There is counter version being Baheri P.S. Case No.225 of 2017. Considering the aforesaid fact that no specific allegation of assault is made against the petitioner and there is a case and counter case, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga, in connection with Baheri P.S. Case No.226/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
