2. Petitioner seeks regular bail in connection with Sonpur P.S. Case No. 877 of 2024 dated 27.10.2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, total 1209.6 litres of illicit foreign liquor was recovered, out of which 172.8 litres of illicit foreign liquor was recovered from the cattle shed of the petitioner.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case merely on the basis of suspicion. Nothing was recovered from the conscious possession of the petitioner and petitioner has no
Patna High Court CR. MISC. No.26927 of 2025(2) dt.27-06-2025 2/2 concern with the alleged recovery. Petitioner is in custody since 24.03.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application and submits that petitioner carries one criminal antecedent.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.- II, Saran at Chapra, in connection with Sonpur P.S. Case No. 877 of 2024.
