The petitioners are apprehending their arrest in a case registered under Section188, 353, 409, 420, 467, 468 and 34 of the Indian Penal Code.

Petitioners are Government's servants and were working as Panchayat Secretaries and allegation is that they did not submit the papers of teachers appointed on contract in spite of direction of the superior authorities.

Submission of the petitioners is that in fact the petitioners have complied the aforesaid direction and even if the allegation is assumed to be correct, this may be a case of disciplinary proceeding for insubordination and no criminal offence is prima facie made out.

Let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds

Patna High Court Cr.Misc. No.41690 of 2016 (4) dt.16-11-2016 of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Kurtha P.S. Case No. 120 of 2016 to the satisfaction of the Chief Judicial Magistrate, Arwal, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
