Counsel for the petitioners informs the court that during the pendency of the application the petitioner No.1Kuldeep Paswan was arrested and as such the application on his behalf has become infructuous. Petitioner is apprehending arrest in connection with Jagdishpur P.S. Case No. 202 of 2017 for the offence under sections 420, 386, 341, 323, 504 and 505/34 of the Indian Penal Code.

The allegation in the instant is that the petitioner no.1 who has been arrested in the instant case has demanded Rangdari and threatened dire consequences.

No.14493 of 2018(2) dt.06-04-2018 2/2 The allegation against this petitioner is that father of the this petitioner Bhola Singh sold out the entire land of his share to his mother and others about 50 years ago and on account of his foul play, the present dispute arose. Considering the entire facts and circumstances particularly the land dispute and mutation case filed by the parties and considering the fact that the petitioner has no criminal antecedent, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur, in connection with Jagdishpur P.S. Case No. 202 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
