2. Petitioners apprehend arrest in connection with Fulwaria P.S.Case No.114 of 2017 registered for an offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 337, 338 and 504 of the IPC.
3. Allegation is that altogether fifteen persons named in the FIR intercepted the informant. They abused and assaulted him by means of lathi and danda. Out of fourteen persons co-accused
Patna High Court Cr.Misc. No.39452 of 2017 (3) dt.17-10-2017 2/2 Sonu Manjhi inflicted farsa blow on the head of the informant and one Sri Ram Singh who came for his rescue. The said Sonu Manjhi is not petitioner before this Court. The informant sustained only one injury which was found simple in nature caused by hard blunt substance. The allegation of assault appears omnibus against these petitioners. There is also a counter case which was lodged by the wife of petitioner no.2 for the offence under Sections 307, 354, 436, 379 and other Sections of the IPC and SC/ST Act cases vide Fulwaria P.S.Case No.115 of 2017.
4. Considering the nature of allegation facts and circumstances, prayer for anticipatory bail is allowed. Let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender within a period of six weeks from today on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-XIII, Gopalganj in connection with Fulwaria P.S.Case No.114 of 2017 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
